Man Arrested for Misusing 911

Eugene, Ore. – On April 25 at about 3 a.m., a man identified as Avery Allen Boniface, age 23, of Eugene began calling the Eugene Police Department’s non-emergency number.

 

He called multiple times over the course of several hours without a true purpose or need. He made requests that didn’t make sense and was verbally abusive to the call-takers. Officers responded to his residence in the north Garden Way area, but he would not answer the door. He called the non-emergency number approximately 350 times that morning, before stopping in the afternoon.

On April 26, Boniface began again calling 911 without an emergency or legitimate need. He placed about 150 calls between midnight and 6 a.m. and continued to be abusive towards call-takers. He was advised multiple times for misuse of 911.

 

Officers responded and tried to speak with Boniface by phone and at the apartment door. There was no progress and Boniface continued to call in to 911. An officer wrote and applied for a search warrant, which was granted by a judge.

The EPD Crisis Negotiation Team attempted to negotiate with Boniface, but he refused to communicate with them. He had been asking for his firearms back, which had been surrendered previously. Due to the nature of the calls, and potential safety concerns, Eugene Police SWAT served the warrant and tried to get him to come out. During this, officers had to resort to deploying pepper balls to quickly and safely take him into custody.

 

 

Boniface was lodged at Lane County Jail for Misuse of 911 and Contempt of Court ( violation of release agreement). Case 22-06452
